Do I Need to Serve a Party Wall Notice?

What Happens if I've Been Served a Party Wall Notice?

If your neighbour has sent you a Party Wall Notice, don’t worry, this is a normal part of many types of building work.

As an Adjoining Owner, you have the right to:

  • Appoint your own surveyor (usually at your neighbour’s expense)
  • Request a record of your property’s condition before works begin
  • Have any concerns addressed before work starts
  • Be protected from damage during and after the project

Acting for the Building Owner

We support you in carrying out your project legally and fairly:

  • Review your proposed works and liaise with your design or build team
  • Identify Adjoining Owners using Land Registry records
  • Prepare and serve the required Party Wall Notices
  • Inspect the neighbour’s property and create a detailed Schedule of Condition
  • Prepare and serve the Party Wall Award
  • Monitor works where required and reinspect post-completion for any damage

Acting for the Adjoining Owner

We help protect your property and ensure the correct procedures are followed:

  • Review any notices and documentation served on you
  • Arrange a joint inspection of your property and agree a Schedule of Condition
  • Negotiate and agree the Party Wall Award on your behalf
  • Monitor the works during and after construction to assess for any damage

About the Party Wall etc. Act 1996

The Party Wall etc. Act 1996 is legislation designed to prevent and resolve disputes between neighbouring property owners when certain building works take place near or on shared boundaries.

It applies when a Building Owner intends to carry out:

  • Works directly on or near a boundary line
  • Alterations to a shared (party) wall or structure
  • Excavations near an adjoining building

The Act sets out a clear process for notification, agreement, and dispute resolution, ensuring construction works can proceed while protecting both parties’ interests.
